OVERVIEW

This website is operated by LumiSkinGlow®. Throughout the site, the terms "we", "us" and "our" refer to LumiSkinGlow®. By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms").

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

SECTION 1 - ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country, state, or province of residence, or that you are the age of majority and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time.

SECTION 2 - PRODUCTS AND PRICING

We reserve the right to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis.

All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time.

Prices for our products are subject to change without notice. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

We do not guarantee that product descriptions or other content on this site is accurate, complete, reliable, current, or error-free. If a product offered by us is not as described, your sole remedy is to return it in unused condition (subject to our Return Policy in Section 4).

SECTION 3 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You agree that we may charge your credit card for any orders placed by you or by anyone using your account, and that we are not responsible for any unauthorized use of your account.

SECTION 4 - HYGIENE, RIGHT OF WITHDRAWAL AND REFUND POLICY

In accordance with consumer protection laws regarding cosmetic, personal care, and health-related items (including the UK Consumer Rights Act 2015, Consumer Contracts Regulations 2013, and applicable EU directives):

UNOPENED PRODUCTS
Customers have the right to withdraw from their purchase within 14 days of delivery, provided that:
- The external security seals and shrink-wrap of the LumiSkinGlow packaging remain completely unbroken and intact.
- The product is returned in its original, unused, and undamaged condition with all original packaging, tags, and documentation.
- The return is initiated by contacting us at legal@lumiskinglow.co.uk within the 14-day cooling-off period.

OPENED OR USED PRODUCTS
Due to strict hygiene requirements, health protection regulations, and the direct skin-contact nature of our Smart LED Skin Jewelry, LED Stickers, and cosmetic Lumi Glitter products, opened, tested, used, or tampered products are strictly exempt from the 14-day right of withdrawal.

Opened or used products cannot be returned, exchanged, or refunded under any circumstances, except where a statutory right (such as faulty goods under consumer law) applies.

FAULTY OR DAMAGED PRODUCTS
If you receive a faulty, damaged, or incorrect product, you must notify us within 48 hours of delivery with photos and a description of the issue. We will assess the claim and, where valid, offer a replacement, repair, or refund at our discretion.

NON-RETURNABLE ITEMS
The following are non-returnable for hygiene and safety reasons:
- Any product where the security seal has been broken
- Used or tested LED modules, stickers, or glitter
- Products purchased during sales or promotional events (unless faulty)

RETURN PROCESS
To initiate a return of an eligible unopened product:
1. Email legal@lumiskinglow.co.uk within 14 days of delivery
2. Include your order number and reason for return
3. We will provide a return authorization and instructions
4. Return the product in original condition at your own cost (unless the return is due to our error)
5. Refunds will be processed within 14 days of receiving the returned item

SECTION 5 - WARRANTY AND LIMITATION OF LIABILITY

MANUFACTURER'S WARRANTY
We provide a 1-year limited manufacturer's warranty on the technical core of the Smart LED Skin Jewelry Module. This covers:
- Internal circuitry
- Battery performance under normal use
- Bluetooth chip functionality

This warranty does NOT cover:
- Damage resulting from improper use, including but not limited to physical impact, crushing, bending, water submersion, or exposure to extreme temperatures
- Natural wear and tear of adhesive surfaces, glitters, or decorative elements
- Damage caused by unauthorized modifications or repairs
- Normal degradation of battery capacity over time (typical for rechargeable devices)
- Cosmetic damage that does not affect functionality

WARRANTY CLAIMS
To make a warranty claim, contact legal@lumiskinglow.co.uk with your order number, proof of purchase, and description + photos of the issue. We reserve the right to request the defective product be returned for inspection.

DISCLAIMER OF WARRANTIES
We do not guarantee that your use of our Service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.

LIMITATION OF LIABILITY
In no case shall LumiSkinGlow®, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility.

Because some jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

SECTION 6 - INTELLECTUAL PROPERTY

All content included on the site, such as text, graphics, logos, images, photographs, audio clips, digital downloads, data compilations, and software, is the property of LumiSkinGlow® or its content suppliers and protected by international copyright, trademark, and other intellectual property laws.

The compilation of all content on this site is the exclusive property of LumiSkinGlow® and protected by international copyright laws.

You may not reproduce, duplicate, copy, sell, resell, visit, or otherwise exploit for any commercial purpose any portion of the Service, use of the Service, or access to the Service without our express written consent.

SECTION 7 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If you send certain submissions (such as contest entries, reviews, comments, suggestions, ideas, or other materials), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us.

We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website.

- to submit false or misleading information;
- to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet;
- to collect or track the personal information of others;
- to spam, phish, pharm, pretext, spider, crawl, or scrape;
- for any obscene or immoral purpose; or
- to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet.

We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

In no event will LumiSkinGlow®, our affiliates, partners, directors, officers, employees, agents, contractors, interns, suppliers, service providers or licensors be liable for any loss or damage of any kind arising from the use of the Service or any products procured through the Service, including direct, indirect, incidental, punitive, special, consequential or exemplary damages.

SECTION 10 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless LumiSkinGlow® and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 11 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

You agree that any legal action or proceeding between you and LumiSkinGlow® shall be brought exclusively in the courts located in the United Kingdom.

SECTION 14 - CHANGES TO TERMS OF SERVICE

We reserve the right, at our sole discretion, to update, modify or replace these Terms of Service at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
